1.1 These Terms and Conditions constitute a legally binding agreement (“Agreement”) between Neo Garage Doors (“We,” “Us,” or “Our”) and You (The person accepting these Terms and Conditions). By using the Neo Garage Doors Website, associated software, processes, and networks, including purchasing Products or services, You acknowledge your acceptance of these terms.
1.2 Your utilisation of the Neo Garage Doors Website or the placement of an Order implies your consent to the following Terms and Conditions. This constitutes a legally binding Agreement between You and Us for the provision of Products.
1.3 The complete Agreement, combined with your Order, constitutes the entire arrangement for Product supply between You and Us. No modifications to the Agreement are valid unless they are mutually agreed upon in writing or via email.

3.1 Prices on the website are subject to change without prior notice. Once an Order is accepted and a Purchase Contract is formed as per clause 6, the price cannot be altered except in specific circumstances.

4.1 Product features and specifications may change without notice. After an Order is accepted and a Purchase Contract is formed, features and specifications will not be materially altered.
4.2 Dimensions and weights of Products detailed on the Neo Garage Doors Website are approximations.
5.1 To initiate an Order, simply adhere to the instructions available on the Neo Garage Doors Website. By initiating an Order, you present an offer to engage in an agreement aimed at acquiring the Product(s) specified in your Order (referred to as the Purchase Contract).
5.2 Once an Order confirmation is sent to your designated email address by Neo Garage Doors, the receipt of Orders will be considered confirmed.
5.3 Neo Garage Doors operates as an online business and chiefly communicates with Customers through email. The Customer bears the responsibility of ensuring that accurate contact details are provided, and the designated email address is consistently monitored for correspondence.
5.4 Neo Garage Doors retains the right to decline the initiation of a Purchase Contract and reserves the option to cancel any Order prior to dispatching the corresponding Product(s).
5.5 In situations where an Order is cancelled, the entire funds associated with that Order will be fully refunded. You will receive an email confirmation notifying you of the cancellation and the subsequent refund.
5.6 Neo Garage Doors does not hold liability for Orders that encounter rejection, delay, or failure to be accepted due to disturbances in internet connectivity.
5.7 In the event that circumstances beyond the reasonable control of Neo Garage Doors (or its affiliates) cause a delay in fulfilling obligations outlined in this Agreement, Neo Garage Doors will not be held liable. Additionally, Neo Garage Doors will be entitled to a reasonable extension of time to carry out said obligations.
5.8 Should you provide an inaccurate or incomplete delivery address for your Order, the possibility of a redelivery fee per subsequent delivery attempt may be charged by us.
6.1 During the purchase process outlined on the Neo Garage Doors Website, you may provide your chosen credit card.
6.2 Order payment processing occurs immediately upon Order confirmation.
6.3 Our fraud prevention protocols may necessitate additional information or transaction rescinding. If requested details are not provided within 7 days, your Order will be cancelled, and payment refunded. These measures aim to prevent online fraud.
6.4 If a Product’s correct price is inaccurately listed on the Website, we will contact you for your preference: purchasing at the correct price or cancelling the Order. We’ll charge the lower price if it’s lower than the listed price and refund the difference if a higher incorrect price was charged.
7.1 We make every effort to ensure the timely and punctual delivery of all Products. Nevertheless, occasional delays can occur due to shipping and factors beyond our control. Neo Garage Doors assumes no liability for any loss or damage resulting from such delays.
7.2 The dispatch date indicated on the Website is an estimated date reasonably determined by Neo Garage Doors. If the scheduled dispatch of a Product is postponed by more than a week, Customers will be notified via email using the address provided in their Order. Customers have the option to cancel their Order and receive a refund according to the Returns Policy before the Product(s) are dispatched.
7.3 Products will not be delivered to Parcel Locker addresses, and orders with Parcel Locker as the receiving address may be subject to cancellation.
7.4 If a Customer authorises the delivery of Products without requiring a signature, any associated insurance coverage will be rendered invalid.
7.5 Our chosen couriers or postal services will deliver Products during standard local business hours (9 am to 5 pm, Monday to Friday, excluding public holidays).
7.6 The delivery times for Products are not the responsibility of Neo Garage Doors. Once Products are dispatched, it is the Customer’s responsibility to coordinate with the designated courier indicated by Neo Garage Doors (as communicated to the Customer) regarding the delivery date and time. Neo Garage Doors cannot be held responsible for inaccuracies in the information provided to Customers concerning delivery dates and times.
7.7 Neo Garage Doors retains the right to refrain from shipping to remote or rural locations.
8.1 We address faulty or damaged Products in line with Warranty Conditions and consumer guarantees under the Australian Consumer Law.
9.1 The consumer guarantees established by statute, including those under the Australian Consumer Law, are not excluded, restricted, or modified by any provision in these Terms and Conditions.
9.2 It may take up to 10 business days for all refunds to be processed.
9.3 Unless in alignment with the specific Product Return Policy, refunds are strictly confined to those allowable under the statutory clauses.
9.4 To initiate a return for a Product that was ordered through the Website, kindly reach out to us via email.
9.5 Customers are required to follow staff instructions in order to facilitate the return process.
9.6 Returned Products, as per the Returns Policy, should be submitted in their original packaging along with all accompanying accessories, and they must be in a condition suitable for resale. It’s important to note that this provision doesn’t impede your entitlement to assert a claim that might be available to you due to a failure to meet the guarantees stated under the Australian Consumer Law. If you’re returning a Product due to a defect or fault under the Australian Consumer Law guarantee, you might be allowed to return the Product even without its original packaging.
9.7 Regarding clause 10.8, the responsibility for ensuring the secure return of items rests with the Customer. We do not hold accountability for Products that go missing during transit.
9.8 In instances where you are returning a Product to us due to our inability to fulfill a consumer guarantee, you are responsible for the return expenses unless returning, removing, or transporting the Product incurs significant costs due to either: The nature of our failure to uphold the consumer guarantee, or the size, height, or method of attachment of the Product.
9.8.1 If you are returning a Product to us due to its incompatibility or unsuitability for your specific requirements, you are responsible for covering the return expenses. It is your responsibility to ensure that you select the appropriate Product that aligns with your needs, utilizing the technical information provided on the Website. If you need guidance, the Neo Garage Doors Technical Team is available to offer assistance.
9.8.2 In situations where you return a Product to us, we do not bear responsibility for Products that go missing during the transit process. If clause (b) is applicable, we will arrange for the collection of the Products at our expense within a reasonable timeframe.
